There is one thing you can do...in case the builder owns some land!

Accept the further payment, but demand his land paper for safety and register this action at district office.

If he is willing it might be a way forward...if not, you know the answer!

This is possible but sometimes even the staff in the distric office don't know it...or don't want to know it! I got this confirmed from a well know lawyer in B...
